Release of liability,
assumption of risk & agreement.

1. Voluntary participation and assumption of risk

I voluntarily choose to use transportation services provided by Beevr, LLC (“Beevr”). I understand that transportation to, from, and around mountain-bike and other recreation destinations involves risks, including vehicle accidents, rough or poorly maintained roads, road hazards, weather, traffic, delays, wildlife, loading and unloading bicycles or other equipment, bike-rack or trailer issues, remote locations, delayed rescue or evacuation, and the conduct of other persons. I knowingly assume these and all related risks.

2. Scope of transportation service

Beevr's service is limited to transportation between agreed pickup and drop-off locations. Service begins when I board the shuttle and ends when I exit it. Beevr does not provide guiding, trail supervision, route selection, navigation, rescue, or medical services.

3. Release and waiver of claims

To the fullest extent allowed by law, I release and agree not to bring claims against Beevr, LLC and its owners, members, officers, employees, contractors, drivers, agents, representatives, successors, and assigns (the “Released Parties”) for injury, death, loss, property damage, or other harm arising from or related to the transportation services. This release includes claims arising from the ordinary negligence of a Released Party, but does not apply to any claim that cannot legally be released or waived.

4. Rider responsibility and readiness

I am responsible for my own navigation, trail selection, riding decisions, skill level, safety equipment, water, food, repairs, and emergency decisions once I leave the shuttle. I confirm that I am physically able and appropriately skilled to participate in my planned ride, and that I will use appropriate protective gear. I am responsible for knowing the route and understanding applicable public- and private-land boundaries, closures, access rules, and trail conditions.

5. Transportation safety and driver directions

While the shuttle is moving, I will wear a seat belt when one is provided, remain safely seated, and follow reasonable safety directions from the driver. I will not interfere with the driver, distract the driver, or create an unsafe condition for other passengers, equipment, the van, or the trailer.

6. Timing, delays, changes, and lodging

I understand that weather, traffic, road conditions, vehicle problems, trail conditions, emergencies, access restrictions, and other circumstances may change pickup, arrival, or return times and may require a change of date or destination. If lodging is required for any reason, I am responsible for my own lodging costs and arrangements unless Beevr agrees otherwise in writing.

7. Communication and remote-area readiness

I understand that pickup areas, roads, and trail systems may have limited or no cell service. I am responsible for providing accurate contact and emergency-contact information, keeping my phone reasonably available when practical, and bringing the supplies and communication plan I consider necessary for my ride. Beevr does not guarantee cell service, trail communication, rescue coordination, or contact with a rider after drop-off.

8. Injury and service continuation

If I or another rider is injured on the trail, Beevr may make reasonable transportation decisions for the safety and needs of the group. I understand that Beevr may continue transporting other customers to the original or a modified destination and is not required to abandon other customers or alter the entire service because of one rider’s injury.

9. Bicycles, motorcycles, belongings, and other equipment

I am responsible for the condition, securement, and use of my bicycle, motorcycle, personal belongings, and other equipment. I will inspect my own equipment before use and promptly tell Beevr about any condition that may affect safe loading or transportation. Beevr may decline to load equipment that cannot be safely secured, exceeds available capacity, or presents a safety concern. To the fullest extent allowed by law, Beevr is not responsible for loss of or damage to bikes, motorcycles, valuables, or other equipment during loading, transportation, unloading, storage, or use.

10. Damage caused by a rider

I am responsible for damage to the shuttle, trailer, racks, or other Beevr property caused by my actions, my equipment, or the actions of a minor or other person for whom I am responsible. This includes damage caused by failing to follow loading, unloading, or driver safety instructions.

11. Refunds

Refund requests are evaluated by Beevr on a case-by-case basis. A change, delay, cancellation, or modified destination does not automatically create a right to a refund.

12. Conduct and prohibited substances

I agree not to use drugs, alcohol, vape products, or tobacco products in the shuttle, on or around the van, or on or around the trailer. Beevr may refuse or end service when conduct, intoxication, equipment, or other circumstances create a safety risk or violate this agreement. No refund is guaranteed when service is refused or ended for safety or misconduct.

13. Emergency medical consent

If I am unable to make decisions during an emergency, I authorize emergency medical evaluation, treatment, and transportation that responding professionals consider appropriate. I understand that I am responsible for related medical costs and insurance claims.

14. Minors

Every rider under 18 must have this agreement signed by a parent or legal guardian. The parent or legal guardian confirms that they have authority to sign for the minor and agrees to the terms on the minor’s behalf.

15. Separate signature for each rider

Each adult rider must sign a separate waiver. A parent or legal guardian must sign a separate waiver for each minor rider.

16. Agreement not to sue and indemnity

To the fullest extent allowed by law, I agree not to sue or make a claim against any Released Party for a matter released by this agreement. I also agree to defend, indemnify, and hold the Released Parties harmless from claims, demands, liabilities, damages, costs, or expenses, including reasonable attorney fees, arising from my own conduct, my equipment, my breach of this agreement, or the conduct of a minor or other person for whom I am legally responsible.

17. Voluntary agreement and acknowledgment

I have had an opportunity to read this agreement, ask questions, and seek independent advice before signing. I understand that I am giving up certain legal rights by signing it. I sign voluntarily, without relying on any statement not written in this agreement, and confirm that the information I provide is accurate.

18. Utah law, venue, and severability

Utah law governs this agreement, without regard to conflict-of-law rules. To the extent allowed by law, any dispute relating to this agreement or Beevr's transportation services must be brought in a court with proper jurisdiction in Utah. If any part of this agreement is found invalid or unenforceable, that part will be limited or removed only to the minimum extent necessary, and the remaining parts will continue in effect.

19. Electronic records and signatures

I agree that this agreement may be presented, accepted, and signed electronically. I intend my electronic signature, checked acknowledgment, typed name, or other approved electronic signing action to have the same effect as a handwritten signature to the extent allowed by law. I agree that Beevr may keep an electronic copy of this agreement and send me a copy using the contact information I provide.

20. Entire agreement

This agreement is the complete agreement between me and Beevr concerning the transportation service and replaces prior discussions or understandings about its subject matter. Any change must be in writing and approved by Beevr.

21. Seasonal duration and future rides

This agreement applies to Beevr transportation services provided from the date I sign it through December 31 of that same calendar year. It applies to shuttle rides, pickup and drop-off transportation, loading and unloading of my equipment, and related transportation services provided during that period. A new agreement is required for rides in a new calendar year.

Before each ride, I agree to confirm that my contact information remains accurate and that I have no change affecting my ability to participate safely. Beevr may require a new agreement at any time, including when services, routes, equipment, or agreement terms materially change. For a minor, this agreement expires no later than the minor’s eighteenth birthday and a parent or legal guardian must sign any required replacement agreement.
